The courtroom drama between the estranged Ambani brothers intensified on Thursday as the government’s legal representative joined the fray to establish that the government has the final say when it comes to any contracts on the gas from any territory in the country. And RNRL counsel finally agreed that the government should be made a party and not just an intervener in the case. Before wrapping up his argument, the government counsel said that the production sharing contract (PSC) signed with government is the mother document and the contractor, in this case RIL, draws power from this PSC. In fact, the private MoU of two Ambani brothers, the government counsel said, should be subject to the PSC. But the real drama began when the top law officer of the government, solicitor general Gopal Subramanyam, said that NTPC is a government company and the government will save the interest of its company by filing additional affidavit, which means NTPC will be given special status while deciding on the price of gas.
Although RIL counsel Haris Salve agreed to the government’s proposals, RNRL lawyers vehemently opposed the government stand on NTPC. It was one of the rarest day when all top lawyers of the country and top law officers of government argued under the same roof. Also, it was one of the rarest gesture where veteran Ram Jethmalani, representing RNRL, agreed to make the government a party. However, his demand of cross-examining government officials was finally rejected by the Supreme Court.
